Will of Abraham Tozer, esquire, of Alphington

This is the last Will and Testament of me Abraham Tozer of Alphington in the county of Devon esquire that is to say I give devise and bequeath unto my son Abraham Tozer of Alphington aforesaid Gentleman and his heirs and assigns for ever all my messuages lands tenements and heredits and all other my real property and estate whatsoever & wheresoever situate and the reversions remainders rents issues and profits thereof and of every part thereof and all my estate right title and interest therein To hold the same unto and to the use of my said son Abraham Tozer his heirs and assigns for ever And whereas I did sometime since settle certain parts of my personal estate and effects in Trustees upon trust for the benefit of myself and children Now I do hereby ratify and confirm that Settlement as far as relates to my said children and I give and bequeath unto my said son Abraham Tozer his heirs executors administrators and assigns the legal estate and interest of and in all mortgages and messuages lands tenements and hereditaments in mortgage to me that the same may be lawfully converted assigned and released in such manner as the persons entitled thereto shall direct and appoint I give and bequeath to my niece ffrances Tozer twenty pounds to my niece Rebecca Tozer twenty pounds to my niece Mrs Hannah Burckett twenty pounds and to my nephew William Tozer twenty pounds to be severally paid as soon after my decease as may be and of which I beg their acceptance as a mark of my affection and esteem also I give to my friends Diederick Arnold Belfield of Heavitree esq and Seth Hyde of Exeter Woollen Draper two of the Trustees named in the Settlement before mentioned the sum of ten pounds each of which I beg their acceptance as a mark of my esteem and all the rest residue and remainder of my goods chattels personal and testamentary estate and effects of what nature or kind soever (subject to the payment of my debts legacies and funeral expences) I give devise and bequeath unto my said son Abraham Tozer his executors administrators and assigns (and I do hereby nominate and appoint my said son Abraham Tozer sole executor of this my last Will and Testament and I do hereby revoke and make void all former Wills by me at any time heretofore made In Witness whereof I the said Abraham Tozer the Testator have to this my last Will and Testament set my hand & seal this twenty eighth day of March one thousand eight hundred and twenty Abram Tozer

Codicill Having in this my Will dated March the twenty eighth one thousand eight hundred & twenty given sundry Legacies to my Nieces Miss Tozer Mrs Burkett & Mr Willm Tozer I do hereby revoke & disannul the whole of the legacies so given & do now direct my trustees instead thereof to give my niece Miss ffrances Tozer two pounds & ten shillings & Miss Reb Tozer two pounds & ten shillings only & Mrs Hannah Burkett two pounds & ten shillings only Mr William Tozer of Chatham Burkett two pounds & ten shillings only of which I beg their acceptance as a small token of my affectionate regard and esteem which I request they will lay out in the purchase of a Ring of that value or any peice of plate more agreeable dates this tenth day of July one thousand eight hundred and twenty Abram Tozer
