Estate Duty Office Will of George Northcott (1817)

By this my last Will & Testament I George Northcott of Lapford in the County of Devon Carpenter Do Give Devise & Bequeath of my worldly Estate & Effects as follows, that is to say First I give Devise & Bequeath unto my Daughter Ann Northcott all that my Dwelling House and shop now in the possession of my Son John Northcott together with the Eastern part of my Garden separated from the West part thereof by the Alley that goes from the West [Lane?] Of the [Door?] of the House wherein I now dwell to the Mark or Post [painted with old paint] in the South of the s[ai]d Garden and also the two Western Lengths or Parts of my [Livery] adjoining the Western part of the s[ai]d Garden To hold the said Dwelling House shop Eastern part of the Garden his Lengths of my Livery & Premises unto my a[foresaid] Daughter Ann Northcott her heirs & Assigns forever. But if my s[ai]d Daughter Ann Northcott shall happen to die having no Issue born under Wedlock then &in such [case] from & immediately after the Death of my s[ai]d Daughter Ann Northcott I hereby Give and Devise the same Premises to Will the Dwelling House & Shop Eastern part of the Garden & the two Western lengths of the s[ai]d Livery unto my Son John Northcott his Heirs & Assigns for ever And I hereby subject & Charge the s[ai]d Premises hereby given to my said Daughter Ann Northcott to & with the payment of the Sum of [five] Pounds within one year next after my Decease unto my Daughter Jane Cooke  & also to & with the Payment of Sixpence yearly for ever unto Court Barton as an Acknowledgement or Head Rent so as to have liberty to fetch Pot Water at the Well in the accustomed place Also I hereby Give & Devise unto my Son John Northcote the Dwelling House wherein I now live together with the little House under the [Stairs] together with the west part of the Garden before the s[ai]d Dwelling House being the Remainder thereof & separated from the East part by the Ally afores[aid] & also the eastern part of the livery being the Remainder that was not before given To Hold the s[ai]d dwelling House Little House West part of the Garden & East part of the s[ai]d Livery unto the s[ai]d John Northcott his Heirs & assigns for ever He or they paying thereout yearly & every Year Sixpence or an Acknowledgement or Head Rent unto Court Barton in this Parish so as to have Liberty to fetch Pot Water at the accustomed Well Also I do hereby Give Devise & Bequeath unto my Son Richard Northcott all that new Built Dwelling House Shop & Premises in the Possession of Samuel Heal together with the plot of Ground [part] of Lapford Given in front of the said House to be taken straight from the front Wall of the s[ai]d new Built House to the Road to the East & to be separated on the west from the Garden in the possession of William Challice  by a Path or Road to be left for entrance to the s[ai]d New Built House & there in possession of William Challice which s[ai]d Path is to be taken straight up by the East [side] of William Challice’s Garden Wall part to be use them eighteen Inches in the [cleare?] the s[ai]d Part of Ground is bounded on the southeast by the Road To Hold the s[ai]d New Built House Shop & Plot of Ground unto my sa[i]d Son Richard Northcott his Heirs & Assigns for ever But it is my will & Hereby strictly now & direct that my said Son Richard Northcott his Heirs & Assigns fo ever shall not at any time hereafter build or erect any House or Wall or any Building or his s[ai]d Plot land within Twenty feet of any Part of my Garden lying to the North of the s[ai]d Plot of Land on pain of paying out of the s[ai]d New Built House & premises the Sum of Twenty Pounds to be paid if his Brother John Northcott & his Sister Ann Northcott in equal [pa]rts or their Heirs or Assigns to be paid to them immediately on his or their Erection of any such Wall or Building as afores[ai]d And I hereby charge the s[ai]d House & Premises hereby given to the s[ai]d Richard Northcott with the payment thereout yearly & every year of sixpence as an acknowledgement or head Rent unto Court Barton so as to have Liberty to have Pot Water there at the accustomed Well Also I hereby Give unto my Son Richard Northcott the Sum of five Pounds to be paid to him [above: & by my Son John Northcote out of the House Garden & Premises hereby given to him] within one year next after my Decease Also I hereby give unto my Sons George Northcott , William Northcott , Roger Northcott & James Northcott all that my dwelling House , Shop , Garden , & Premises now in the Possession of William Challice To Hold the same to them their Heirs & Assigns for ever share & share alike to be equally divided between them Also I Hereby charge the s[ai]d House Shop Garden & Premises hereby Given to my s[ai]d Four Sons to & with the Payment of Six Pence yearly for ever unto Court Barton as an Head Rent for Liberty to have Pot Water at the accustomed Well as afores[ai]d Also I hereby Give unto the [Occupiers?] for ever of the House hereby given unto my [written above: dauther Ann] [written above: Son John] Northcott Right & Liberty to have full access to the [Nurssary?] House situated in the Western part of the Garden hereby Given to my Son John Also I hereby Give & Bequeath unto my Daughter Ann Northcott my second best Bed stead Bedtye & Bolster , also my Clock & Case & my [Dresser?] All the rest Residue & Remainder of my Goods Chattels & Effects after Payment of any such Debts, Funeral Charges & Proving This my Will I do Give & Bequeath the [same?] unto my Son John Northcott whom I hereby nominate & appoint to be Sole Executor of this my last Will & Testament And Lastly my Will & Meaning is that should any Loss Damage or Expence occur or happen to my s[ai]d Executor by Reasons or Means of any Defect in the Title Of the House at Eastenton  That I lately Sold to John Densham that then in Such Case all my s[ai]d Children shall consitutute & pay their Share towards the Same equally on pain of forfeiting all his or their Estate and Interest (so refusing) on this My Will 
In Witness whereof I the s[ai]d George Northcott the Testator have hereunto set my Hand & Seal the Twentieth Day of May One thousand Eight Hundred & Sixteen Also I [above: hereby] Give unto my Daughter Jane Cooke the sum of five pounds to be paid her by my s[ai]d Executor

Executor named in the last Will and Testament of George Northcott late of Lapford in the said County and Archdeaconry of Barnstaple [written above: carpenter] who died on the tenth Day of October 1816 make it the Oath and will that he has made diligent search and due enquiry after and in respect of the Personal Estate and Effects of the said Deceased, in order to ascertain the full a-mount and value thereof and that to the best of his knowledge information and belief, the whole of the Goods, Chattles, and Credits, of which the said Deceased died possessed, within the Archdeaconry afore-said (exclusive of what the Deceased may have been possessed of, or instituted to as a Trustee for any other Person or Persons, and not beneficially, but including the Leasehold Estate for years of the Deceased, wheter absolute or determinable on Lives, and without deducting any thing on account of the Debts due and owing from the Deceased), are under the Value of One hundred pounds And this Deponent further [with] that the said Deceased had no Personal Estate and Effects at the time of his decease_________ within any other Jurisdiction to which this Deponent need to Administer
